Best True Lawyer Story Of The Year

There's always more to the story. The media just likes to put a shocking spin on those cases.

Remember the McDonalds case where some lady spilled hot coffee on herself and sued for over a million? Sounds bad right. Well they dont broadcast the fact that the coffee was so hot it caused this 80 something year old woman to get third degree burns over a large percentage of her lower body... including, yes, her vagina. Requiring skin graphs... on her vagina. Sound like the coffee was served at an appropriate temp to you? The coffee burner was left on negligently, allowing the coffee to get insanely hot.

You dont win money in court unless the other side did something wrong. The news likes to leave that kinda stuff out, because you all eat it up.

And we can sue any Chinese or any foreign corporation that sells anything in this country. Its not difficult.

Shit is made in China because the labor is cheap there, pretty basic.

it was worse than that - McDonalds was advertising their coffee was hotter than their competition and the coffee was handed through the window to this poor lady at 180*.... of course, it's all the lawyer's fault. They probably should have sued the car maker too for not putting enough cup holders in the car...

... and yes, we sue Chinese corporations - it's called being amenable to suit; and the nutshell is this, you sell it here, you're subject to our laws.

it's funny, you're complaining about US lawyers, when the laws in the land where you live are draconian at best...

Its ok Bangcock Dean, you missed my point too. You can sue any foreign corporation selling products here, like SuperBuickGuy said. The exact same way you can sue a US corporation.

If US corporations are getting sued more, its because theyre fucking up more.

You cant sue a company for failing to fill out a form, unless their failure to do so caused some person an economic loss. But then, shouldnt that person be able to sue?

Dont be a product of the media and poorly communicated hearsay.

PS, huge verdicts like that are almost always granted by juries. Meaning, your neighbors (not lawyers, not judges) listened to the whole story and decided on that amount. People that sat in the court room for 2 weeks and heard all of the facts... the same kind of people that watch it on the news and mock it on the internet... but with all of the facts at their disposal.

Sorry but a law firm files a class action suit on behalf of the citizens of the state of NY on this company that used a controlled chemical and were supposed to file a form after so much was used over a certain amount. This company had never used a big amount in past years and were unaware that they were to file anything. The law firm represented no one but themselves and only kept track of all companies in the state who failed to file certain required forms. How do you say ambulance chaser...:crap:

Surely there are good lawyers some where that do an honest days work, unfortunately you only hear of the bad or selfish ones.:2nd:

Finally Asian companies can sell cheep not only due to cheap labor they don't need to pay lawyers or settle suites in there own country, it has nothing to do with being sued in the land of litigation.

There is also loads of people from Europe and the Americas that come to Asia for medical treatment due to great care at low costs.
Partly due to hospitals and doctors not having to pay big malpractice insurance costs. Many hospitals here have top doctors with state of the art equipment. Plus the nurses are hot and friendly...

And I could see a company getting sued for failing to file a form concerning hazardous chemicals. But youd only get money if you proved damages.

And yes, there are ambulance chasers out there. But Id say lawyers get a bad rap, because most of them are good people. One of my best friends is a prosecutor, she dedicated 8 years of her life to undergrad, law school, bar study, and now 60 hours a week at least to keeping criminals off the street. Shes a civil hero, and shes prob the kindest, nicest, most sincere person Ive ever met.

Really? so it's all the lawyers fault, that's funny. Who do you think goes to these lawyers? Or do you really believe they go door-to-door to find clients? According to you, it couldn't possibly be the client's fault.

In a society that says "I am my own god" and "whatever I think is right must be right" you blame the lawyers for the complete lack of morality and right-doing? Your fundamental misconcept of the law and how it's created, applied and defined is utterly amazing. A lawyer's job is to argue a side of an issue - yet there are two sides. If one lawyer doesn't do his (or her) job and an undeserving person gets paid, it's not the system or the law that is to blame. However, your response is typical - you sit in judgment where you have no clue as to what the facts or the case presented. Remember, it was a jury of YOU who decided the person needed to be paid. Now you leave the court and suggest that your neighbors and friends are fine, but it's the lawyer's fault for the person(s) getting big bucks. It wasn't the lawyer, it was the jury.

So if the state had filed the same action, it'd be okay? After all, most times the State has to agree to let a private individual enforce environmental laws...

Nevermind the fact that it was the legislature - made up of the citizens of NY - who made the law and its enforcement mechanism.

And that's funny about going elsewhere - if your health care is so good, why did the Canadian PM come to the US for treatment? Doctors are rightly concerned about being sued because Doctors are unsympathetic, pill pushing, creeps who make most of their money investing in drug firms, biomedical, and by being expert in med mal cases. Being concerned about oversight makes them better doctors - it's why we have the best health care in the world.


About settling cheap. My wife works as a mechanical engineer doing medical devices. US companies test their products on 3rd world and eastern block countries because it is cheaper to test on them than on monkeys in the US. Focus on the word "test" - the world is our monkey.... how do you like that viewpoint? but then again, in those other countries they can just breed more test subjects. Want to make the mental leap to figure out why we get away with that? Do you seriously think we could pull that off if there was a working judiciary that protected its citizens?

That said, Asians have no trouble ripping off US firms and selling their fake product abroad. I love the justification given "well, it's too expensive from the US" then the next line "it's all the lawyer's fault that it's so expensive"..... want to know a good day? it's a day that customs takes a container load of fake Nike shoes and burns them on our shores. To me, it's utterly immoral to use money as the reason for theft of another person's hard work, investment and effort.

yeah, hate on the system all you want - here's a revelation for you, there are laws in place because people will do what the law prohibits and you should stop them from doing that....

I almost made that point too, its good to keep companies in check. The result is less bleach and human fingers in our microwave dinners.

And btw, lawyers cant go door to door. They cant even contact people directly, or by 'real time' electronic communication. People first have to go to lawyers, its true, thats how it starts.
 
I have ZERO respect for the entire legal/jurisprudence system of this nation....all run by crooks from top down.....

spent 53 years in the DC region, and the infection from that town has taken over this nation.....even I don't believe it, and I lived it.....

Why not live somewhere where you do respect the judicial system? Its an awful bold move living somewhere when you dont respect arguably the most powerful branch of the government.

I wouldnt want to live somewhere if I felt I had no recourse if I were to get swindled, stabbed, or murdered.

Been swindled, and the Feds backed it up.....got the proof, iron clad, been over ten years now, still got the box, I can read, guess the judge got paid under the counter....the man LIED on his BK application.....

and THAT don't include a childhood experience from when I was like age ~13 or so....

the job of the judiciary is to make both sides equally unhappy. Success (of a judicial decision) is when both sides blame the party that couldn't care less.

just as welfare is a opiate to give the poor something to lose (in a revolution, you have nothing to lose)... the judiciary is to keep people from fighting by giving something else to make them mad. Of course, if you're in Court the rest of the public couldn't care less about your issues - so you'll never get them to take your side against the process.... clever, no?

BANKRUPTCY COURT is definately FEDERAL, in the Fed Dist. Ct. and it's crooked as hell, paid for by the guy I chased through there....

When I say FEDS, I mean the entire Federal power structure.....

crooked as hell, BTDT, and experienced it at the street level myself here in NE Florida....back in '98-02 by time it was all settled out....
