The people in Ohio got what they deserved. Next election cycle vote the azzholes who brought this about out of office.:bonkers:
Exactly.
You probably won't change anything, but it'll pass along a message to the azzholes in government that "
we the people" still means something!
That is what is so bad about this. This isn't a law, it's a Ohio supreme court ruling (which effectively makes it a law)! No one to vote out of office, no recourse.
This, like most traffic laws, has nothing to do with making the roads safer. It has to do with generating income for the state. In effect, it's another tax.
That's pretty much exactly what it is, taxation without representation!!:crap:
I'm sure there will be appeals to a higher court (the state supreme court is not the last say in the matter.) Even though you may not be able top vote the state supreme court judges out, you CAN vote the lawmakers and politicians that supported this :crap
utta there!
Now here's the kicker, and what I expect will be the defining factor in judgments of guilt and fine assessments.
Exactly how fast officer? Since the officer has absolutely no way of determining an exact speed when "estimating", there's no way they can determine the correct fine amount when assessing "damages."
If they do, appeal that. Not the ticket, the fine amount
This BS will also tie up the courts like there's no tomorrow. Shit! I'd pay the damned fine just to tie up the judge until 2 am:smash:
And you're right. It's about the $$$$ not traffic safety. If it were about safety, everything would be automated, regulated and you'd loose your liccense on the first couple of violations. There would be mandatory retraining (hands on, not this BS dog and pony show we have now) and minimum standards for drivers of all ages!
Nice! it's going to rain speed tickets over there
Correct, if they are short on money this is an appealing way to get it..
It's a shame.
I see a little bit of good in it. I was at the gas station last year and the guy flew by in a hemi dart ,kids everywhere (sounded good ). The cop chased him down and could only give him a warning because he didnt have his radar out. The guy was doing 60 plus in a 35 and could have killed someone.
I'm sorry, but although I see your point, I see absolutely NO GOOD in this ruling
It's total bullshit, bad for the citizen, bad for the courts and bad for the police.
As a retired motor cop, I've written my share of tickets. I've never written BS cases, unless I had some azzhole that just talked him/herself into it.
We use "estimates" to support the radar/lidar reading, not in place of it.
I can estimate speed pretty damned well. At the time, I used to be able to determine it within +/- 5mph of the actual speed. It was a requirement of certification to be able to demonstrat this 25 times in a row.
But if I hit it on the money, it was luck, pure and simple.
Sure, any monkey can tell when your doing 50-60 in a 25...that's a no brainer.
And if you're "resourcful" enough, you can find an applicable statute to cover the violation without radar/lidar support (careless/reckless/spped too fast for conditions, etc). Not only that, you can use the advanced speed as PC to make the stop, do a complete vehicle inspection (believe me, this takes a while
), check all the paperwork, DL, criminal, mommas history, 1st born child.......you get the point.
not only can I probably fill up a ticket book, but I can get my point across to the violator very well without resorting to this kind of BS.
I think it sets a very bad prescedent over all
Sorry for the long assed rant, but as a professional, this kind of crap pisses me off!
